The UIGEA will be challenged before the US Third Circuit Court of Appeals in April by the Interactive Media Entertainment and Gaming Association, according to a post on the iMEGA website this morning. The court gave iMEGA representatives a list of possible dates for oral arguments to be presented, as well as advising the US Department of Justice of availability as the primary defendant. The Federal Reserve and Federal Trade Commission are also named in the suit.
The action asks the court to declare the 2006 act unconstitutional in its attempt to prevent payment transactions involving online gambling sites. The suit says the law against Internet casino payments should be ruled "void for vagueness", and points out that Congress cannot require financial institutions to determine the legality of individual online gambling sites.
